1. Introduction & Acceptance of Terms

Welcome to Maxwild Hub ("we," "our," or "us"). By accessing or using our website, platform, and automated expense tracking and tax services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Nature of Services

Maxwild Hub provides software tools and professional administrative support to assist commission earners and self-employed individuals with expense tracking, record keeping, and tax compliance preparation.

  • User responsibility: You are solely responsible for providing accurate, complete, and truthful financial records, receipts, and income declarations.
  • No fiduciary audit: Maxwild Hub processes information based on the input provided by the user and does not conduct independent audits of your bank accounts or receipts unless explicitly contracted under a separate, written engagement agreement.

3. Account Registration & Security

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.

4. Subscription Fees, Billing, and Grace Period

  • Fees: Access to certain features of Maxwild Hub requires a paid subscription. All fees are displayed in South African Rand (ZAR).
  • Billing: Subscriptions are billed on a recurring basis (monthly or annually) via our payment gateway provider (Payfast).
  • Non-refundable: Payments are non-refundable except as explicitly provided in our Refund Policy or required under applicable South African consumer law.
  • Default and read-only access period: If a recurring payment fails or is cancelled, your account will automatically enter a 30-day Read-Only Grace Period starting from the end of your last paid billing cycle.
  • During the grace period, you retain access to log in and download existing reports and previously uploaded documents.
  • During the grace period, you cannot upload new entries, add new expenses, or process new data.
  • Automated processing tools and services will be paused during the grace period.

5. Data Privacy, POPIA Compliance & Retention

  • We process personal and financial information in accordance with the Protection of Personal Information Act (POPIA) of South Africa.
  • Your data is used strictly for providing and improving our Services and complying with SARS compliance standards.
  • We implement robust security measures to protect your personal information against unauthorized access, loss, or misuse.
  • Data retention & deletion: In accordance with POPIA Section 14 retention principles, we do not retain your personal information longer than necessary. Upon the expiration of the 30-day Read-Only Grace Period, stored personal and financial data will be permanently deleted or anonymized, subject to any statutory record-keeping obligations under South African tax law.

6. Intellectual Property

All content, branding, user interfaces, software code, and materials available through Maxwild Hub are the intellectual property of Maxwild Hub (Pty) Ltd. You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal or internal business purposes.

7. Limitation of Liability

To the maximum extent permitted by South African law:

  • Maxwild Hub shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the platform.
  • Maxwild Hub is not liable for penalties, interest, or additional tax liabilities levied by the South African Revenue Service (SARS) resulting from inaccurate, late, or incomplete information provided by you.
  • Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to Maxwild Hub in the 12 months preceding the claim.

8. Termination & Account Suspension

  • User cancellation: You may cancel your subscription at any time through your account settings.
  • Suspension for non-payment: Failure to maintain active payment will result in immediate transition to the 30-day Read-Only Grace Period outlined in Clause 4.
  • Full account closure: Following the conclusion of the 30-day Read-Only Grace Period, your account will be fully suspended and locked. Access to download stored documents via the platform will cease.
  • Termination by us: We reserve the right to suspend or terminate your account immediately if you breach these Terms or misuse the platform.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
